Europa League: Sion complain to the European Commission

The case of Sion vs UEFA continues. As the Swiss justice keeps on asking for FC Sion to be brought back to the Europa League and the UEFA stands firm on its willingness to leave any decision to the discretion of the Court of Arbitration for Sport at the end of November, the Swiss club has filed yet another juridical case, this time in front of the European instances.

In a press release, the FC Sion affirms it has (as well as some of its players) lodged a complaint to the European Commission for “unfair restriction of the competition, abuse of dominant position, violation of the right to be awarded an independent and impartial judge, as guaranteed by the article 47 of the Chart of Fundamental Rules of the European Union, violation of the right of free-circulation of workers and of the free offer of services as guaranteed by the bi-lateral treaties between the European Union and Switzerland”. In order to try and bring the European Federation to give in, the Sion management add that they requested the Commission to inflict the UEFA a fine amounting up to 10% of its annual revenue.

Furthermore, the FC Sion as reaffirmed its hostility regarding a judgement by the CAS, which they don’t consider as independent in its decisions. This new attack from the FC Sion, this time at an European level, could be explained by the arrival as a judicial advisor of Belgian Attorney Jean-Louis Dupont, one of the instigators of the Bosman regulation in 1995.
